Substitute teacher arrested on suspicion of molestation

A substitute teacher at Los Coyotes Middle School in La Mirada was arrested Monday on suspicion that he molested a female student in a classroom.

Los Angeles County Sheriff’s Sgt. Dan Scott of the department’s Special Victims Unit said the mother of a female student reported to Norwalk sheriff’s station deputies Thursday that her daughter told her a male substitute teacher, Ted Nishihara, had touched her in a sexual manner during class. Scott said the girl is a preteen.

On Monday, detectives went to the school and interviewed students, staff members and others. Investigators then contacted Nishihara at his home.

Scott said that after interviewing Nishihara, detectives arrested him on suspicion of lewd acts upon a child. He was booked at the Cerritos sheriff’s station. His bail is set at $200,000.

According to Nishihara’s resume, he graduated in 2006 with a bachelor of arts in psychology. He has previously worked at the ABC Unified School District in Cerritos and Garden Grove Unified as a substitute teacher. He has also worked for Long Beach Unified as an instructional aide.

Clovis Unified Fires Teacher Accused of Molestation

Clovis Unified has fired a teacher accused of molesting a child. It comes over month after a second grade teacher was arrested and charged with child pornography and sexual abuse.
Clovis School Board President says, “We have sought the truth, however painful because the truth is what will help us to heal.”
Heal after shocking allegations came forward at Freedom Elementary. 44-year-old Neng Yang is accused of using his power as teacher to take advantage of a second grade girl.
He was arrested back in January and has since pleaded not guilty to child pornography and 45 counts of sexual abuse.
On Monday, the Clovis Unified School Board met behind closed doors to vote on whether Yang should have a job.
The closed session meeting took under five minutes before Van Volkinburg announced the decision. He says, “Our action today brings closure to employment of the individual at the center of recent disturbing events in our district.”
By law, Clovis Unified had to wait 30 days. The time allowed Yang a chance to defend himself. School officials say that day has come and gone.
In a court room, Yang is still innocent until proven guilty, but school officials say there was enough evidence to take action now before a ruling is made.
Yang is behind bars at the Fresno County Jail. His bail is set at $4.5 million. He’s due in Federal Court on April 9th.

Physician’s Assistant Charged With Child Molestation

FBI agents arrested a San Diego man accused of taking pictures and video with young naked girls.
He worked as a physician’s assistant at the Naval Medical Center in Balboa Park

“It’s tragic, repulsive, and I think would make most people sick to their stomach,” FBI Spokesperson April Langwell said.

Federal agents say 38-year-old Brandon Schroth is seen in digital files touching minors.

“They’re staged on a mattress in a bed.  There were video depictions of him in a bathtub naked with two pre-pubescent girls,” Langwell said. “Very young 8 to 9 year-old girls.  There is no doubt they are engaging in child pornography.”

Schroth worked as a physician’s assistant at the Naval Medical Center in Balboa Park.

Rica Kennedy lived next door to Schroth for a year and a half, until he moved out of the Mission Valley apartment last month.

“I was shocked because he’s in the military and I think he works at the hospital.  I hope he’s not…I’m just shocked,” Kennedy said. “That’s scary.  Especially here at this complex, there are a lot of kids here.”

Schroth is being charged with two counts of child sex exploitation. His detention hearing is set for March 8.

Miramonte coach arrested on suspicion of sex with student

A migrant community specialist and coach for Miramonte High School was arrested Friday on suspicion of unlawful sexual intercourse with a minor, police said.

Bakersfield police reported the investigation into Saul Noe Lopez, 31, began when a local merchant reported that a school employee operating a Kern High School District van had purchased condoms at his store.

Kern High School District police identified Lopez as the man who bought the condoms, Bakersfield police reported. A 16-year-old student was identified as the alleged victim.

The investigation was then handed over to Bakersfield police because of the nature of the alleged crime.

Bakersfield police determined Lopez had transported the student from the campus to his home, where a sex act took place, according to police.

Lopez was booked into the downtown jail Friday evening.

No other students have been identified as victims, police said.

KHSD spokesman John Teves said Lopez, who had worked at Miramonte since the school’s opening in 2008, resigned Friday. Lopez was coach of the girls’ varsity soccer team.

As a migrant community specialist, Lopez worked as a liaison between the school and local migrant families, Teves said. It is not a credentialed position.

Teacher’s aide reportedly from San Pedro hit with 4 sex charges

A teacher’s aide from Fremont High School in South Los Angeles was charged today with four felony sex-related counts.

Alain Salas, 40, was scheduled to be arraigned this afternoon in Compton Superior Court on three counts of committing a lewd act on a child and one count of contact with a minor for a sexual offense, according to the District Attorney’s Office.

According to his Facebook site, Salas is from San Pedro and lives there. The FBI says Salas lists a Los Angeles street address as his residency.

The criminal complaint alleges that the crimes occurred last year between Oct. 1 and Nov. 30 and involved a 15-year-old girl identified only as “Jane Doe.”

Salas began working at Fremont in 2006 as a teacher’s aide for special education students, and also helped coach girls softball and volleyball, according to the Los Angeles Unified School District.

He was arrested Monday by members of the FBI’s Sexual Assault Felony Enforcement team.

“The SAFE team is working with the alleged victim’s family and the school district, and is continuing to investigate the nature and extent of the allegations,” said FBI spokeswoman Laura Eimiller.

Prosecutors were asking that Salas’ bail be set at $300,000.

Napa coach pleads no contest to sex offenses with teen

A coach for two Napa girls’ softball teams pleaded no contest Thursday to sexual offenses against a 16-year-old team member earlier this year.

Christa Tharp, 34, of Napa, pleaded no contest to felony charges of oral copulation and sexual penetration with a foreign object on a person under age 18 and two misdemeanor charges of child molestation, her attorney Beverly Saxon Leonard said this morning.

Tharp faces up to eight years in state prison when she is sentenced Nov. 10, Saxon Leonard said.

“We will seek local jail time,” she said.

Tharp was a volunteer coach for the Napa High School girls’ softball team and a coach for the Napa Valley Express girls’ team, Saxon Leonard said. The victim was on both teams.

Tharp and the girl developed a relationship and became good friends, and although the sexual conduct between March and July was consensual, it was illegal, Saxon Leonard said.

It began after Tharp separated from her husband and moved in with the 16-year-old girl’s family, Saxon Leonard said.

The sexual relationship came to light when the parents of other girls on the team notified authorities of their suspicions about the “unusual” relationship between player and coach, Saxon Leonard said.

Police were informed about the relationship on July 11 and Tharp was arrested on four felony charges on July 22.

Tharp was released from jail but was taken into custody again when she violated a civil

restraining order against her by meeting with the girl three times, Saxon Leonard said.

Several misdemeanor charges of contributing to the delinquency of a minor and contempt of court were then added to the complaint, she said.

Napa County Superior Court Judge Mark Boessenecker will dismiss those charges and two felony charges at sentencing, Saxon Leonard said.

Tharp pleaded no contest on the day of her scheduled preliminary hearing and remains in custody.

Youth Pastor Arrested on Suspicion of Committing Lewd Acts With Girl

BENICIA (KRON)–Police say they have arrested a Solano County youth pastor suspected of committing lewd acts with one of his underage female Bible study students.
According to police, 38-year-old John Edward Gamboa was booked into Solano County Jail Tuesday on suspicion of committing lewd acts with a minor. Police say they are not identifying the church or the name of the girl since she is under the age of 14.
Police say Gamboa and the girl knew one another before they allegedly began talking and texting each other earlier this year. According to police, the parents learned of the communication and warned Gamboa to stop the inappropriate behavior after mediating the issue through the church. Police say Gamboa allegedly continued to meet with the girl on various occasions and engage in kissing and inappropriate touching with her.
Lieutenant Mike Daley said the girl’s parents contacted police after the girl’s mother found inappropriate text messages on her daughter’s phone. Daley said the girl had admitted the behavior to her mother.
Police say Gamboa was contacted by authorities and admitted the allegations during a statement at police headquarters. He was arrested without incident.

Church choir director arrested on suspicion of lewd acts with girl in San Bernardino County

Montclair Police Department Sex Crimes Unit is investigating a 53-year-old choir director allegedly caught with a 15-year-old student Sunday morning.

Police say a patrol officer was on routine patrol when he noticed a suspiciously-parked vehicle in an alley in the 10200 block of Central Avenue at 9 a.m. Sunday.  When the officer approached, he allegedly saw Mark Michaels (pictured) with the girl, “performing lewd acts.”

Michaels was arrested and is being held at the Rancho Cucamonga West Valley Detention Center. Michaels is being held on $50,000 bond.

Upon further investigation, police said the young girl was a student of Michaels, who is a choir director at Bethany Baptist Church in the 9900 block of Monte Vista Avenue.

“During the investigation that information was provided to us by both parties,” said Lt. Jason Reed.

Reed said the two have known each other for approximately two years.

Detectives worry there could be more victims and hope that anyone with information will step forward.

If you or a loved one is involved in a serious or fatal sexual abuse incident:

  • Insist that a report is filed by the Police Department or Sheriff’s Department;
  • Obtain essential information (i.e., name, address, insurance information, adults name, business address of any and all persons involved in the abuse incident);
  • Photograph the visible injuries and keep copies of all documentation;
  • Shut up!  Talk to no one about the incident or your injuries other than your attorney or doctor, never to an insurance adjuster or insurance investigator.  Do not volunteer a statement to any insurance company especially one who works for the sexual predator;
  • Sign absolutely nothing without consulting a lawyer;
  • Seek medical attention immediately and keep a diary of your level of pain;
  • Keep all receipts for all medical expenses and/or funeral bills and wage loss records;
  • Contact the Law Offices of Gary A Kessler an experienced law firm immediately to protect your rights and preserve the evidence!

Demand accountability from those responsible for the sexual abuse incident.  An adult is a person who owes your child the “highest duty of care!” Many times the insurance companies for the foster care companies (i.e., many times they are “self insured”) will play “hardball” if you try to settle the case yourself or you have employed a lawyer who does not have the litigation experience to handle such a complex sexual abuse case.  We at the Law Offices of Gary A Kessler have twenty years of litigation experience and know how to handle the insurance companies to your advantage.  Remember, cases against the churches and schools have a very short time to file the proper government claim which must be filed first, way before the actual lawsuit is filed! We are prepared to front all costs required for the neccessary investigation and expert witnesses needed to prepare your case for trial as well as file all government claims.  Unfortunately, the reality is that most sexual abuse victims usually sustain serious/catastrophic injuries which many times results in death.  Over the past twenty years attorney Gary A Kessler has a proven successful track record demanding accountability from the responsible parties and obtaining outstanding results for his clients.

The laws regarding sexual abuse cases are complex and include many facets of the law.  It is vital to surviving family members to seek the advice of an experienced sexual abuse lawyer such as Gary A Kessler at the Law Offices of Gary A Kessler to protect your rights and those of your loved ones.

U C Berkeley doctor charged with molesting male patients

OAKLAND — A doctor who worked at UC Berkeley’s health center for more than two decades has been charged with sexually assaulting at least six male patients during examinations and university officials believe more victims could come forward.

Dr. Robert Kevess, 52, of Oakland, was charged late Wednes-day with 19 felony counts, including eight counts of sexual exploitation of multiple patients, seven counts of sexual battery with false professional purpose and four counts of sexual penetration by a foreign object. Prosecutors say the offenses occurred between March 2006 and this March.

Kevess confirmed the allegations of sexual misconduct to police officers investigating the case, saying he touched intimate parts of patients and penetrated them with objects, including his fingers, under the guise of performing medical procedures, court records state.

“The allegations were confirmed by statements made by Kevess during a subsequent interview,” a probable cause arrest warrant written by UC Berkeley police states. “Interviews of Kevess and the victims confirmed Kevess subjected the victims to (sexual misconduct).”

It is unethical and illegal for doctors or other health care providers to have sexual relations with a patient, under the code of medical ethics from the American Medical Association.

against their will and for the specific purpose of sexual arousal, sexual gratification and sexual abuse while said person was unconscious of the nature of the act because the perpetrator fraudulently represented the touching served a professional purpose.”

Alameda County deputy district attorney Susan Torrence said “unconscious” does not mean the patient was drugged or not conscious at the time of the suspected acts, but rather “unaware” that what was going on was not part of the exam.

Police said the six male victims were between 18 and 42 years old. University officials and prosecutors declined to give specifics on why patients went to see Kevess or what exactly he is accused of doing to them. Patients and doctors both have the right to request that an attendant be in the room during examinations, but no attendant was present during the suspected abuse.

Kevess graduated from New York University School of Medicine in 1984. University officials said a June 2010 review of his professional conduct and background, as required by law for recredentialing, did not identify any “issues of concern or complaints from patients.” Kevess was reaccredited at that time.

Mogulof said the 300 medical professionals who work at the clinic have been notified of the criminal charges.

“The news was received with a profound degree of shock and sadness, as it has been across the campus,” Mogulof said.

“The charges allege that this individual violated many of the ethical, legal and professional limits designed to preserve the integrity of the doctor-patient relationship.”

Torrence said there might be other victims who will come forward in the coming days and weeks. “In a case like this, it’s not unusual for other victims to come forward and I would not be surprised if others came forward.”
