Serious Injuries
Mom run over twice, saved baby from truck
A mother who pushed her 2-year-old son out of the way of a big rig was injured Thursday morning when she was struck and run over by the truck in downtown Fresno.
Witnesses said the woman — Alicia Dougherty, 30, of Fresno — may have saved her son’s life while suffering injuries, including scrapes and bruises. The child, whose name was not released, also suffered a cut on his right foot, police said.
Stephanie Gonzalez, who witnessed the collision, stopped her car to run to the aid of the victims.
An ambulance rushed the victims to Community Regional Medical Center. Police and witnesses said the woman had the right of way as she crossed southbound E Street at Fresno Street just before 9 a.m. and the truck, which was southbound on E, turned right to Fresno Street and struck the woman in the crosswalk. Fresno police officer Joe Ploharz said it was likely that the truck driver did not see the woman because the height of the truck obscured his vision.
Several people, including Gonzalez, said the truck driver was on a cellular phone as he made the turn, but Ploharz said he had not heard that from the witnesses that he had interviewed.
The driver of the truck, Tejpal Sandhu, 35, of Newark, was cited for failing to yield to pedestrians in a crosswalk, police said.
After the truck struck the woman, the driver backed up, inadvertently rolling a front wheel of the rig back over the woman, who had tire marks on her leg as she and the child lay crying in the street.
Fault and Serious Injury Liability
Accidents involving big-rigs have unique and complex legal issues. If it is determined that the driver of the big-rig was at fault for this collision, the family of the victim would be well-advised to speak to a California truck accident attorney. An experienced and knowledgeable attorney will be able to review the cause of the accident, and if warranted, arrange for an independent investigator to reconstruct the collision to determine exactly what happened and who was responsible. A skilled lawyer can also provide an explanation to the victim’s family on their legal rights in a wrongful death claim against the driver or any other parties at fault. Damages awarded in a personal injury claim may include ambulance, hospital bills, lost earnings, pain and suffering, and other damages.

Woman killed in big rig crash on I-680 in San Jose
A horrific scene unfolded on a freeway off ramp Thursday morning when a tumbling big rig fell on top of a car, crushing a passenger to death and critically injuring the truck driver, the California Highway Patrol said.
The collision was reported just before 10 a.m. as the rig driver was getting onto northbound Interstate-680 from eastbound McKee Road, said Officer DJ Sarabia. The male driver lost control while taking the cloverleaf on ramp, causing his trailer to fall onto a passing gray Toyota Camry occupied by two women.
The passenger, described as being in her 40s, was killed at the scene. The Camry driver, a woman in her 20s who may be the victim’s daughter, was taken to Valley Medical Center with minor injuries.
The rig driver, a man in his 30s, was taken to Regional Medical Center in San Jose — located less than a mile from the crash site — with critical injuries, Sarabia said. The trailer was filled with broccoli, but the load did not spill out.
Within moments of the crash, onlookers gathered along the south side of the overpass and peered through chain-link fencing as authorities righted the trailer and moved the wrecked Camry onto a tow truck. The victim remained inside the vehicle and will be taken to the coroner’s office for extraction, away from public view, Sarabia said.
Authorities shut down the offramp from northbound I-680 to westbound McKee Road, as well as the onramp from eastbound McKee Road to northbound I-680. Sarabia said motorists should expect delays and blockages until at least 2 p.m.
Cause of the San Jose Big-Rig Crash
A preliminary investigation suggests that speed was a likely cause for the overturn. According to Officer D.J Sarabia of the California Highway Patrol “We think he was going too fast to make that curve”.

Woman attacked by two pit bulls in Long Beach
LONG BEACH, Calif. (KTLA) — A woman had to undergo surgery after she was attacked by two pit bulls while walking her dog in Long Beach.
The attack happened just after 6:00 p.m. Saturday on the 200 block of East Barclay Street.
According to Long Beach police, two bystanders tried to fight off the dogs but were attacked as well.
Officers arrived on the scene and were able to locate one of the pit bulls.
After several attempts to stun the dog with a Taser, officers opened fire on the dog.
That dog died from its wounds.
The second dog was found nearby and was taken into custody by Animal Control.
The woman sustained serious, but non-life threatening injuries.
Her dog was also attacked and was taken to a local animal hospital for treatment.
One of the Good Samaritans was taken to the hospital and treated for dog bites.
The second sought private treatment, also for bites.
Dog Attacks and personal injury liability
CALIFORNIA DOG BITE STATUTE SECTION 3342
Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite. One bite alone is sufficient for liability. Dog owners do not get a second chance in California. They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously. Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:
- Defendant owned the dog;
- The dog bit the Plaintiff;
- The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occured; and
- Plaintiff sustained injuries from the dog bite.
What You Should Do If You Or A Loved One Has Been Bitten By A Dog:
- Take pictures of your injuries immediately;
- Consult law enforcement and request that a police report be made;
- Keep copies of all medical bills and records;
- Continue to take pictures of the bite(s) as the wounds heal;
- Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
- If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.

2011 statistics
- 31 U.S. fatal dog attacks occurred in 2011. Despite being regulated in Military Housing Areas and over 650 U.S. cities, pit bulls led these attacks accounting for 71% (22). Pit bulls make up less than 5% of the total U.S. dog population.2
- Notably in 2011, adult victims of fatal pit bull attacks more than doubled the number of child victims. Of the 22 total pit bull victims, 68% (15) fell between the ages of 32 to 76, and 32% (7) were ages 5 years and younger.
- The year 2011 also marks an increase in pet pit bulls killing their owners. Of the 8 total instances this year in which a family dog inflicted fatal injury to its primary caretaker, the dog’s owner, 88% (7) involved pet pit bulls.
- Together, pit bulls (22) and rottweilers (4), the number two lethal dog breed, accounted for 84% of all fatal attacks in 2011. In the 7-year period from 2005 to 2011, this same combination accounted for 73% (156) of the total recorded deaths (213).
- The breakdown between pit bulls and rottweilers is substantial over this 7-year period. From 2005 to 2011, pit bulls killed 127 Americans,3 about one citizen every 20 days, versus rottweilers, which killed 29; about one citizen every 88 days.
- Annual data from 2011 shows that 58% (18) of the attacks occurred to adults (21 years and older) and 42% (13) occurred to children (11 years and younger). Of the children, 62% (8) occurred to ages 1 and younger.
- 2011 data also shows that 39% (12) of the fatal incidents involved more than one dog; 26% (8) involved breeding on the dog owner’s property either actively or in the recent past, and 6% (2) involved tethered dogs, down from 9% in 2010 and 19% in 2009.
- Dog ownership information for 2011 shows that family dogs comprised 65% (20) of the attacks that resulted in death; 74% (23) of all incidents occurred on the dog owner’s property and 29% (9) resulted in criminal charges, up from 15% in 2010.
- The states of California and Texas led fatalities in 2011, each with 4 deaths; pit bulls and their mixes contributed to 88% (7) of the 8 deaths. North Carolina, New Mexico, South Carolina and Virginia each incurred 2 deaths.

Two Dogs Attack Man Walking Dog, Injure Both
A man and the dog he was walking were both injured seriously enough to require medical attention after they were attacked by two dogs on Friday evening near the intersection of Figueroa Drive and Casitas Avenue.
Ken Hayashi, a neighborhood resident, told Patch he was walking an elderly neighbor’s dog that he regularly helps with and never saw the animals coming. He said the dogs that attacked him were two pit bulls that are usually locked behind a gate near his home. Hayashi said he never saw them coming.
“The dogs came from behind and they surprised the heck out of me,” Hayashi said.
Lt. Duane Allen of the Los Angeles County Sheriff’s Department confirmed that deputies were called to the scene and that Hayashi was transported to the hospital following the attack, which took place around 6:30 p.m. on Friday.
Hayashi said he is now feeling OK, but did need stitches in several areas where he was bitten. The dog he was walking, a dachshund mix named Sammi Jo, had serious punctures to her neck which required stitches. A photo of her injuries can be viewed above.
According to Hayashi, the owners of the dogs have given the animals over to the Animal Control Department since the attack. A department spokeswoman was unable to find record of the dogs or the attack when contacted by Patch, but said she would continue to try to find out more about the dogs.
Lois Todd, a neighbor of Hayashi’s who brought the attack to the attention of Altadena Patch, said she has been concerned about aggressive dogs in her neighborhood for a long time.
Todd, a dog owner herself, said she feels like the neighborhood is not a good place for smaller dogs.
“It seems like there is a pit bull at every house,” Todd said.
Todd brought Sammi Jo to a clinic in Eagle Rock following the attack. She said the dog is a rescue and is nervous around people, which made it hard for the vets to take care of her wounds. She said Sammi Jo had two wounds on her upper neck and back that needed to be drained, as well as punctures in the ears.
Todd said she was unhappy with the response of the Sheriff’s Department, and wished someone had taken away the attacking dogs immediately following the incident.
Lt. Allen said department policy with dog attacks is to contact Animal Control and have them handle the dogs. He said the department will intervene if they witness an attack, but if the dogs are secure behind a gate, as the attacking dogs were by the time deputies got to the scene, then they contact Animal Control to follow up.
Sometimes that can take several hours or longer, Allen said.
Hayashi said his understanding is that the pit bull owners contacted Animal Control to have the dogs taken away.
Additionally, Hayashi said he was unhappy with comments that deputies on the scene made to him when they arrived: he said that the first thing the deputy said was to ask him if he spoke English or not. Hayashi, who is Asian-American and was born in California, said he took offense, especially because he was bleeding and clearly needed medical attention.
Hayashi said he has not filed a complaint with the Sheriff’s Department, and Allen said he has no record of anyone in the neighborhood filing a complaint about how the department handled the incident.

Irish tourist blamed for wrong way crash in San Mateo County
An Irish tourist driving on the wrong side of a remote stretch of Highway 1 in San Mateo County caused a head-on collision Saturday night that left five people injured, police said.
The 34-year-old Irish man, who was not named, “was unfamiliar with American roadways” and ended up driving his Toyota north in the south bound lanes near Tunitas Creek Road around 8:05 p.m., according to the California Highway Patrol. He’d pulled back onto the road after stopping to take some pictures when he suddenly spotted a south bound Acura coming right at him.
In an effort to avoid a crash, the Irish man and the Acura’s driver veered to the right side south bound Highway 1 but collided head on, police said. The 43-year-old man behind the wheel of the Acura and a 42-year woman passenger, both of Pescadero, as well as the tourist suffered major injuries in the crash. They were all rushed to Stanford Hospital, police said.
Two other passengers in the Acura, a 5-year-old girl and 8-year-old boy, both of Pescadero, were left with minor injuries.
Everyone involved in the crash was wearing a seat belt, police said. Investigators aren’t sure if drugs or alcohol played a role in the collision.

4 people injured after rollover accident on Kearny Villa Rd
SAN DIEGO – Alcohol may be to blame for a rollover car crash in the Miramar area that sent four people to hospitals early Friday, police said.
The crash near Kearny Villa and Miramar roads was reported at 3:45 a.m., according to San Diego police Officer Frank Cali.
The driver of a 2008 Honda headed north on Kearny Villa Road, with three passengers on board, over-corrected on a curve and struck a center divider, Cali said in a statement. The car then overturned several times, he said.
All four occupants were taken to local hospitals, including one male passenger who suffered serious hand and face injuries, according to Cali.
“Think of yourself, think of your family. Look at this wreck here. You know you could walk away or you could die or you could hurt somebody and the rest of your life will be destroyed for a little bit of alcohol or talking on the cell phone is not worth it,” John Hendricks of the San Diego Police Department said.
Police say the driver was not under the influence, but the passengers may have been drunk.
Cause of the San Diego Accident

Seguin students injured after school bus crash with big rig, PT Cruiser
SEGUIN — Bits of burnt homework could be seen from the open emergency door, left ajar after a freshman football player helped fellow students off his burning school bus.
“At this time, we have zero fatalities. We are very blessed when it comes to that,” said State Trooper Jason Reyes.
Bus #2 was headed to Barnes Middle School and Seguin High School with 9 children on board, when the unexpected happened along Hwy 123: troopers say a PT Cruiser had moved to the shoulder to allow an 18-wheeler to pass.
It was a courtesy that officers say became complicated.
Trooper Reyes added, “It was at that time that the PT Cruiser was clipped. Once it was clipped, it forced it into the northbound lane of traffic, striking the school bus head on.”
That set-off a chain reaction and a fire, which quickly spread to the four vehicles, charring the twisted mass as children and drivers scurried for safety. All 13-people would be injured, but survived.
Firefighters found the cab of the bus separated from its wheels and upside down. School officials said the bus was 3-weeks old with a modern design that allowed the chassis to detach in a collision, minimizing the impact on passengers.
Seguin ISD spokesperson Sean Hoffmann said, “The fact that the body of the bus isn’t connected to the frame probably saved lives today.”
Hoffman said the bus was unusually unoccupied. Many of the high school seniors had the day off, because students in schools statewide are taking the STARR exams. Hoffmann said the injured students will have to make-up that test at a later date.
The Texas Department of Public Safety’s accident reconstruction team is combing through the wreckage, because troopers say the accident had all the right ingredients of a mass-casualty event.
But, it also had the right people responding at the right time.
“The true heroes in this were some workers on their way to work from Halliburton. From what I was told they helped remove a lot of students from the bus and direct traffic. We got to give praise to those guys,” said Reyes.
The driver of the 18-wheeler was flown to University Hospital in critical condition. The school bus driver and one student are at San Antonio area hospitals. The other victims received treatment at Guadalupe Regional Medical Center in Seguin.
