Serious Injuries
CHP Reports Alcohol played role in fatal Willow Creek bus crash
An unidentified 19-year-old woman was killed and seven other people were injured when a bus drove off a steep embankment on State Route 96 late Friday night, according to a California Highway Patrol press release issued Saturday.
Around 9:50 p.m. a 1993 GMC former school bus driven by Lorenzo Jackson, 42, of Washington state, drove off the right of the highway for unknown reasons approximately four miles north of State Route 299, according to the release. The bus rolled a short distance down a steep embankment, and came to rest against some trees.
Jackson broke his leg exiting the bus, according to the release. Two other passengers exited the bus and remained nearby while two passengers walked up to State Route 96. Three people remained in the bus, including a woman who was pronounced dead at the scene by paramedics.
Deputy Coroner Roy Horton said the woman’s identity is currently unknown, and that the passengers on the bus did not know very much about each other.
During investigation of the crash, it was determined that both Jackson and 35-year-old Joseph Forcier of Florida had driven the bus under suspicion of alcohol intoxication prior to and during the collision, according to the release.
Both men were arrested and remain at medical facilities to be treated for their injuries. Forcier received major head trauma and was transported to Mad River Community Hospital, according to the release.
Five other accident victims were transported to St. Joseph and Mad River Hospitals. The deceased victim’s name has not been released.
Cause of the Humboldt County Crash
As passengers, the deceased and the injured likely could have done nothing to prevent this fatal roll over collision that ultimately took her life and seriously injured several others. The California Highway Patrol will surely look at the speed of the vehicle, witness reports, and other factors to determine what occurred and who was responsible. roll over collisions such as this one can have countless causes, including unsafe passing maneuvers, swerving to avoid an object in the road, falling asleep at the wheel, driving under the influence, or driver distraction. No other vehicles were involved and alcohol is suspected to be a factor.
According to the California Highway Patrol the crash was “due to the Bus driver’s state of intoxication, the driver failed to maintain effective control of the vehicle, which ran off the left side of the roadway”.

The crash happened just after eight last night near the intersection of Jensen and West. The California Highway Patrol is not releasing the identity of the victim.

The big rig overturned at the intersection next to the Fresno Regional Sports Park and spilled about 70 gallons of diesel fuel into the dirt. The Fresno Fire Department received the call at 8:27 p.m., and the department’s Hazmat unit was on the scene to assist with the cleanup.

Man dies in oil field water tank, another suffers broken ankle
A welder died and a superintendent was rushed to a hospital with a leg injury after a Wednesday morning accident inside a water tank in an Oildale oil field.
Authorities said the accident occurred when a temporary platform the two men were standing on gave way at about 9:30 a.m.
The welder, 54-year-old Barry Snelson of Oildale, suffered a head injury and the superintendent fractured his ankle, said Dean Fryer, a spokesman for Cal-OSHA, which is investigating the accident.
The superintendent was not identified. Fryer said both men were working for Brahma Group Inc., an engineering and contracting firm based in Salt Lake City.
Brahma could not be reached for comment.
While details remain sketchy and agencies on the scene provided sometimes contradictory accounts, Fryer said the two workers were testing the tank at the time of the accident.
“What they were doing was bringing water, pumping water into the tank to see where there may be leaks,” he said.
Kern County Fire Capt. Eric Coughran said the men were cleaning up after a welding repair job from the night before.
Coughran said the man with the leg injury was pulled out with a harness about an hour after the accident. He was taken to Kern Medical Center.
Shortly after, the other man was pulled out. He was then pronounced dead at the scene, Coughran said.
The tank measures 15 feet high and 10 feet wide with an 18-inch opening for entry and exit.
The tank is part of Live Oak Cogen, a 46 megawatt, natural gas-fired power plant located in an oil field about 1 1/2 miles west of South Granite Road. In addition to generating electricity, the facility sells steam for heavy oil production nearby.
Snelson’s widow, Diane, said he was a safety-conscious, honest family man who was “excited” to join Brahma earlier this year after being without full-time work for a few months.
“He loves the company that he works for, loves all the people that he was working with. They’re an awesome company,” she said.
Snelson had worked as a welder since the age of 18, she said, describing him as “very safety oriented and very easy-going gentleman.”
The couple have three children: Nicole, 30, living in Clovis; Julie 28, in South Carolina; and Anthony, 25, who lives with his parents.
Beyond Workers’ Comp
Many injured workers assume they are only able to receive workers’ compensation benefits for injuries on the job site. A careful analysis of the accident by an attorney experienced in construction injury claims may reveal other sources of financial compensation. If an employee of another subcontractor was responsible for the falling debris that injured you, we may pursue an injury claim against his or her employer, for example. A general contractor who failed to maintain a safe workplace may also be liable.

At Least 40 Injured in California Train Crash
Repair crews worked removing two derailed cars and a locomotive and to repair damaged railroad tracks after an Amtrak train carrying about 169 passengers derailed in a collision with a big rig truck in California’s Central Valley.
At least 40 passengers suffered minor to moderate injuries, authorities said.
The Monday afternoon crash occurred when the driver of the tractor-trailer carrying cotton trash failed to yield and hit the train, authorities said. The impact pushed the two passenger cars and the locomotive off the tracks south of Hanford, a farming town.
Passenger Edmund Sanders, who said he was riding the train because he had missed a Greyhound bus from Fresno to his home in Los Angeles, was in one of the middle cars when it collided with the truck.
“Right after it happened I see all these people with a terrified look on their faces, all trying to get to the front of the train,” Sanders told the Fresno Bee.
“I tried as best I could to try and calm people down and help them get off that train. I really think that God has his hands on that train today,” he said.
The train traveled about 600 feet after the collision before hitting a switchback and derailing, according to California Highway Patrol Officer Scott Harris.
Officials have not determined how fast the train or the truck were going, but the average speed for Amtrak through the area is 70 to 80 mph, while the speed limit on the roadway where the truck was traveling is 55 mph, Harris said.
After the crash, metal pieces from the truck could be seen inside the train, which was covered by cotton seeds. Several pieces of luggage were also scattered around the area.
Kings County Assistant Sheriff Dave Putnam described the injuries to passengers as bumps, bruises, scrapes and possibly broken bones.
The crash occurred at a crossing that was equipped with gates to stop traffic, Putnam said.
Eight of the injured passengers were taken to Adventist Medical Center in Hanford and five more were expected, said hospital spokeswoman Christine Pickering. She did not provide details on the extent of their injuries.
“We did call in additional physicians and staff,” Pickering said.
Four additional injured passengers were taken to nearby Adventist Medical Center in Selma, while seven people were taken to Community Regional Medical Center in Fresno, officials said.
The train was on its way from Oakland to Bakersfield, according to Amtrak. It had four rail cars and a locomotive.
The truck driver suffered minor injuries, according to California Highway Patrol spokesman Jerry Pierce. Investigators will try to determine if the crash was caused by driver error, a malfunctioning crossing arm, or something else, the CHP said.
“This is a big, huge chaotic scene with lots of agencies involved,” Pierce said.
Pierce said the other passengers were taken to an auditorium in Hanford, where they boarded another train and continued to their destinations or they were picked up by family members.
All train service through the area was halted after the crash.
Initially, Amtrak had expected to resume service through the area in time for the morning rush hour, but Amtrak spokesman Cliff Cole said late Monday that a bus bridge would carry passengers between Bakersfield and Hanford until at least 7:15 a.m.
“We will wait for further word from BNSF to see if we need to make further adjustments,” Cole said.
BNSF Railway Co., which operates the tracks, expected to have the tracks open by 7 a.m., spokeswoman Lena Kent said.
Meanwhile, a second accident, this one around 4 p.m. Monday about 10 miles away involving a freight train and a tractor-trailer, left a truck driver with major injuries, the CHP said.

Hemet dog-bite victim recovering; boxer quarantined
A 63-year-old man suffered serious bite wounds Wednesday afternoon, Sept. 19 when he was attacked by a dog that escaped from a fenced-in yard on Kirby Street in Hemet.
Hemet police Sgt. Dan Reinbolt said Wednesday evening that three dogs had escaped from the yard, but Sheppard said only one dog, a boxer mix, was involved in the attack.
Sheppard said a wrought-iron fence in the dog owner’s yard had a hole in it and the dog was believed to have either gone under or through the fence to escape. The dog’s owner was not at home at the time.
The boxer is being held in quarantine by the society, which contracts with the city of Hemet to provide animal control services.
Sheppard said an animal control officer left a notice at the owner’s house indicating that the fence would have to be mended before the society would consider returning the dog. As of Thursday, he said, the owner had not been cited.
Dog Attacks and personal injury liability
CALIFORNIA DOG BITE STATUTE SECTION 3342
Under California Law, it is no longer necessary for the Plaintiff to prove that the dog was known to be vicious or had a propensity to bite. One bite alone is sufficient for liability. Dog owners do not get a second chance in California. They are liable for any injury their animals cause regardless of whether the animal had bitten anyone previously. Under California Dog Bite Statute Section 3342 the Plaintiff must prove in a dog bite case the following:
- Defendant owned the dog;
- The dog bit the Plaintiff;
- The Plaintiff was lawfully on the premises (express or implied consent to be on the premises) where the bite occurred; and
- Plaintiff sustained injuries from the dog bite.
What You Should Do If You Or A Loved One Has Been Bitten By A Dog:
- Take pictures of your injuries immediately;
- Consult law enforcement and request that a police report be made;
- Keep copies of all medical bills and records;
- Continue to take pictures of the bite(s) as the wounds heal;
- Be sure that your doctor is qualified and determine if you are a candidate for plastic surgery to get rid of the scarring;
- If an adult who is employed sustained injuries and lost wages, keep a record of economic loss.

Rescuers included the Yuba County Sheriff’s deputies and boat patrol, the Nevada County Sheriff’s Department and dive team as well as the California Department of Forestry and Fire Protection, and the Army Corps of Engineers, Gil said.
Boating Accident Personal Injury and Wrongful Death Liability
The most common boating accidents are collisions with other boats, sinking’s, capsizing and boat disappearances.
Boating accidents occur very quickly and in many different places. Lakes, canals, rivers, inter-coastal waterways and oceans are where tragedies normally occur. Last year in California, there were 744 boating accidents involving 439 injuries and 44 fatalities.
According to the United States Coast Guard each year there are more than 8,000 boating accidents in the U.S. that result in 4,000 serious injuries and 800 deaths.
Many times a boater will have been speeding or may have had too much alcohol.
There are specific boating laws that must be followed or fatalities can occur. The Law Offices of Gary A Kessler is familiar with the different state’s boating laws. We know the boating liability issues and will inform you of your true state, local and Federal boating rights and legal options which will result in successful outcome in your case.
It is a general rule of law that the operator of a boat and its owner has a duty to exercise a reasonable degree of care in order to prevent injuries to others. The most common boating accidents are collisions with other boats, sinking and boat disappearance. Boating injuries usually occur because of a reckless or careless operator, alcohol, boat malfunctions or an inexperienced boating (captain) operator.
Operators of boats have a legal obligation to operate their watercraft in a safe and prudent manner. The overwhelming majority of boating accidents are caused by factors that can be controlled by the operator of the boat. The primary cause of boating accidents nationwide was operator inattention, followed by careless/reckless operation, operator inexperience, operating at an unsafe speed, and failure to have a proper lookout.
Common violations of the duty of ordinary care in a maritime setting include a failure to warn against foreseeable harm, violations of “rules of the water,” such as excessive speed, failure to have proper lights, failure to yield, intoxication and others. Owners may also be held liable under the theory of vicarious liability. For example, an owner may be held liable for an operator’s failure to warn passengers of intended maneuvers, overloading the boat or permitting the guest to sit in a dangerous position.
Accidents involving bystanders, such as swimmers or water skiers, are typically treated in the same manner as cases involving social guests. The law and courts where the accident occurred will generally control any lawsuits brought by injured bystanders unless the defendant boat owner asserts admiralty jurisdiction.
The laws regarding boating accident (drowning) cases are complex and include many facets of the law. It is vital to surviving family members to seek the advice of an experienced boating fatality lawyer such as Gary A Kessler at the Law Offices of Gary A Kessler to protect your rights and those of your loved ones.

3-year-old boy hit by car outside Greyhound station
A 3-year-old boy was hit by a car Friday night after he ran into the street outside the Greyhound station in downtown Bakersfield, according to his mother and police.
The child, Garrett Myers, was taken to Kern Medical Center with injuries characterized by police as minor to moderate.
The Riverside boy and two brothers, Dustin, 10, and Ethan, 8, came to Bakersfield with their mother to stay with their cousin, said the mom, Angela Myers.
While she was inside the station at 1820 18th St. charging her cell phone, her sons were outside. That’s when Garrett ran into the street, the mother said.
The car ran over Garrett and dragged him for a bit before stopping, said Dustin, who saw the whole accident with his brother Ethan.
“I couldn’t bear to watch him get run over again,” Dustin said through tears. “I’m terrified.”
Angela Myers said Garrett was conscious and talking to her as he was being taken away in the ambulance.
“I’m scared because he was tensing up, and he just kept saying, ‘Mom, mom,'” she said.
Ana Majano was inside the Greyhound station and saw as police lifted the car to get Garrett out from under it. Garrett had scratches on his back and bruises already forming on his nose and eyebrows, Majano said.
Fire trucks, police and an ambulance were at the scene at about 6:45 p.m. Flares had been set out at H and 18th streets.
The driver was not under the influence of alcohol, Bakersfield Police Sgt. Graydon Argast said.
Police were continuing to investigate Friday night.
