Right of Way

  • Pedestrians always have the right of way. So, no matter where you encounter a pedestrian on the road, they always have the right of way. This includes crosswalks, round-a-bouts, at intersections not marked with signals and at street corners. Crosswalks are sometimes defined by white lines or flashing lights. Crosswalks are outlined in yellow near schools.

California Pedestrian Law

“Under California Vehicle Code Section 21950 (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.

(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”

Pedestrian killed on Highway 50 Douglas’ first fatality of 2012

Authorities have not released the name of the victim in Douglas County’s first fatal accident of 2012.

The accident occurred 12:44 a.m. New Year’s Day when a 21-year-old Walnut Creek, Calif., man walking in the eastbound lanes of Highway 50 was hit by a vehicle.

According to the Nevada Highway Patrol, the man was struck from behind by a 2011 Ford Expedition California Highway Patrol vehicle driven by Officer Joshua J. Varanini, 38 of Truckee.

According to the Nevada Highway Patrol, the man was walking in the left eastbound lane wearing denim jeans and a black jacket.

Varanni stepped on the breaks and steered to the right to avoid the walker, but the vehicle’s left front hit the man and forced him into the opposing westbound lanes where he was hit by a passenger shuttle.

NHP Trooper Chuck Allen said the accident forced the closure of the highway for almost four hours. Eastbound traffic was rerouted out of the area via State Route 207, Kingsbury Grade, while westbound traffic was turned around near the scene. The highway was completely reopened at approximately 4:36 am.

The name of the victim has not been released yet.

Troopers from the Nevada Highway Patrol Major Accident Investigation Team will be investigating this tragedy.

Two Pedestrians Killed in Incline Village Friday Night

The Nevada Highway Patrol says two pedestrians were killed when they were hit by a vehicle in Incline Village Friday night.

Troopers tell Channel 2 News that it happened around 7:30 p.m. on State Route 28. They say it happened by the Radio Shack, near Village Boulevard.

Troopers say the two unidentified pedestrians were crossing the street when a black 2006 Chevrolet pickup truck driving south on State Route 28 hit them.

The truck was driven by 27-year old Christopher Torii Smith of Grass Valley, California who was also carrying three passengers.

Troopers say witness statements and evidence shows the pedestrians were in a painted crosswalk, or nearby one when Smith allegedly hit them.

The male victim reportedly died at the scene, while the female victim died while being taken to Renown Regional Medical Center.

Troopers say the road was closed in both directions for about four hours before opening back up again a little after 11:30 p.m. Friday.

Smith later was arrested and taken into custody Friday night. They believe drugs may have been a factor in the fatal crash.

Smith was charged with two counts of driving under the influence causing death and failure to yield to pedestrians.

The Nevada Highway Patrol is asking anyone who may have information to call Trooper Mike Stapledon at 689-4623 about case number: NHP-111230851.

Cause of the Lake Tahoe Car Accident

If news accounts from North Lake Tahoe Bonanza News  reports are accurate, the pickup driver likely is responsible for causing this accident.  However, the incident is still under investigation by the  Nevada Highway Patrol.
