The San Jose Mercury News reports that three of the dead were from Fairfield and the fourth was a man from Tracy.

Sgt. Kyle Plant said Tuesday that there were no survivors of the crash Monday night on Highway 12 just east of the Sacramento County line.

Plant says it was a “head-on collision – headlight to headlight.”

Authorities found one car on its roof in a ditch, and the other car straddling the east- and westbound lanes of the highway.

Plant says there were no witnesses so the cause of the crash was unclear. The names of the dead have not been released.

Washington woman dies in head-on crash

The Washington State Patrol says a head-on collision between two SUVs on an icy highway has killed a southwest Washington woman and seriously injured three girls.

The Columbian reports that the crash happened Monday evening about a mile south of Battle Ground, Wash., on State Highway 503.

Trooper Stephen Robley says a southbound Nissan Pathfinder crossed the centerline and collided with a northbound Chevy Tahoe. Robley says the 33-year-old Battle Ground woman who died was in the Tahoe, as was a male passenger who was taken to a hospital.

Cause of the Battle Ground Crash

While this devastating Clark County County accident remains under investigation, the family members of the accident victim who was fatally injured would be well-advised to speak with an understanding and knowledgeable  personal injury lawyer. An attorney such as Gary A. Kessler who has successfully handled serious injury accidents can advise the victim’s family of their legal rights to hold the driver accountable and best course of action should they wish to pursue a wrongful death claim.

Automobile Collisions and Wrongful Death Liability

While the accident on January 1 remains under investigation, the   family members of the victim would be well-advised to seek immediate consultation from a personal injury lawyer. The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

The trooper says the three girls in the Nissan, all described as younger than 18, also were taken to a hospital.

A third vehicle ended up under the Tahoe. Two young men in that car were not thought to be seriously hurt.

The highway was closed for about three hours while emergency crews worked to pull the victims free of the wreckage.

Placerville crash kills four, including two children

A horrific two-car collision on Highway 50 just east of Placerville claimed the lives of four people Saturday night, including two children, when a car headed west in the Apple Hill area veered across four lanes of traffic and into the path of a minivan.

Early reports late Saturday had indicated that at least one person had died. Around midnight Saturday the word came that the death toll was much worse.

Three people in the Prius who died at the scene were identified by the El Dorado County Sheriff’s Office as 38-year-old Sheng Kun Su, who was driving; 39-year-old Shu Zhen Zhao; and 8-year-old Shawn Su, all from Oakland.

The other occupant of that vehicle, identified as 10-year-old Elly Aili Su, was hospitalized with severe injuries, CHP Officer Sean Ricci said.

A 4-year-old Pollock Pines girl riding in the minivan, Nora Elizabeth Temple, was pronounced dead at a hospital, Ricci said.

The collision left two other people – the 35-year-old driver, identified as Danielle Marie Temple; and passenger Will John Temple 52 – with minor to moderate injuries. Twin 1-year-old boys, John Maxwell Temple and John James Temple, were also in the minivan but were not injured, Ricci said.

Ricci said he did not know the speeds of the two vehicles or what caused the driver of the car to veer from the westbound slow lane of Highway 50, across the fast lanes in each direction, and into the minivan’s path.

The crash occurred along a stretch of Highway 50 that does not yet have a center divider. Ricci said El Dorado County has been erecting road dividers in recent years tied to location and traffic levels.

4 injured in crash on Highway 101 interchange

Four people were injured Monday afternoon after a crash on the interchange of highways 101 and 33 in Ventura, officials said.

The multiple-vehicle crash occurred about 12:35 p.m. on the southbound side of the highway, according to the California Highway Patrol.

While emergency personnel were en route, they received a report that someone was trapped in a burning vehicle.

Firefighters had to extricate the driver of one of the two vehicles that were heavily damaged in the collision.

The three people in the vehicle received minor injuries and were out of the vehicle by the time firefighters arrived.

Investigators think the crash was caused by a vehicle that entered the 101 the wrong way. That vehicle ran head-on into a second one, authorities said.

All of the victims were taken to Ventura County Medical Center.

All lanes of the highway were blocked after the crash but were reopened about two hours later, the CHP said.

CHP reports fatal head-on east of Porterville blamed on dropped cell phone

An elderly man was killed and an elderly woman sustained major injuries when their Honda sedan was hit head-on by a Cadillac sedan whose driver was distracted by his cell phone east of Porterville just after 3 p.m. Saturday, the California Highway Patrol said.

The CHP described the couple, who were from Lancaster, as elderly but did not provide their ages or names. They were traveling northbound on Success Valley Road north of Reservation Road when a man driving a Cadillac was distracted by his ringing cell phone, attempted to pick it up but dropped it on the floor, CHP Sgt. Joe Vega said. When the man tried to retrieve his phone, the Cadillac veered into the northbound lanes, colliding head-on with the Honda, the CHP said.

The Honda driver was pronounced dead at the crash site and the woman was airlifted to Community Regional Medical Center in Fresno, Vega said.

The four people in the Cadillac, including the driver, sustained moderate injuries and were taken to Kaweah Delta Medical Center. All four live on the reservation, Vega said.

No alcohol or drugs are suspected in the crash, Vega said.

Gary A. Kessler believes enforcement and common-sense safety laws, such as texting while driving bans, can help prevent distracted driving car accidents, and deaths. But legislation is not the only solution. Common sense, personal responsibility and educating drivers about the dangers of distracted driving are all major parts of the solution that will save lives.

Distracted Driving

Each day, more than 15 people are killed and more than 1,200 people are injured in crashes that were reported to involve a distracted driver. Distracted driving is driving while doing another activity that takes your attention away from driving; these activities can increase the chance of a motor vehicle crash.

There are three main types of distraction:

Distracted Driving in the United States and Europe:
A recent CDC analysis examined the frequency of two major distractions—cell phone use and texting—among drivers in the United States and several countries in Europe.
  • Visual—taking your eyes off the road;
  • Manual—taking your hands off the wheel; and
  • Cognitive—taking your mind off what you are doing.

Distracted driving activities include things like using a cell phone, texting, and eating. Using in-vehicle technologies (such as navigation systems) can also be sources of distraction. While any of these distractions can endanger the driver and others, texting while driving is especially dangerous because it combines all three types of distraction.

How big is the problem?

  • In 2009, more than 5,400 people died in crashes that were reported to involve a distracted driver and about 448,000 people were injured.
  • Among those killed or injured in these crashes, nearly 1,000 deaths and 24,000 injuries included cell phone use as the major distraction.
  • The proportion of drivers reportedly distracted at the time of a fatal crash has increased from 7 percent in 2005 to 11 percent in 2009.
  • When asked whether driving feels safer, less safe, or about the same as it did five years ago, more than 1 in 3 drivers say driving feels less safe today. Distracted driving—cited by 3 out of 10 of these drivers—was the single most common reason given for feeling less safe today.
  • A recent CDC analysis examined the frequency of two major distractions—cell phone use and texting—among drivers in the United States and seven European countries (Belgium, France, Germany, the Netherlands, Portugal, Spain, and the United Kingdom). Results of the analysis included the following findings:
    • Cell phone use while driving:
      • 25% of drivers in the United States reported that they “regularly or fairly often” talk on their cell phones while driving.
      • In Europe, percentages ranged from 21% in the Netherlands to 3% in the United Kingdom.
      • 75% of U.S. drivers ages 18 to 29 reported that they talked on their cell phone while driving at least once in the past 30 days, and nearly 40% reported that they talk on their cell phone “regularly” or “fairly often” while driving.
      • In Europe, percentages of young adults who reported talking on their cell while driving at least once in the past 30 days ranged from 50% in Portugal to 30% in the Netherlands.
    • Texting or e-mailing while driving:
      • 9% of drivers in the United States reported texting or e-mailing “regularly or fairly often” while driving.
      • In Europe, percentages ranged from 10% in the Netherlands to 1% in the United Kingdom.
      • 52% of U.S. drivers ages 18-29 reported texting or e-mailing while driving at least once in the last 30 days, and more than a quarter report texting or e-mailing “regularly” or “fairly often” while driving.
      • In Europe, percentages of young adults who reported texting or e-mailing while driving at least once in the past 30 days ranged from 44% in Portugal to 17% in the United Kingdom.

What are the risk factors?

  • Some activities—such as texting—take the driver’s attention away from driving more frequently and for longer periods than other distractions.
  • Younger, inexperienced drivers under the age of 20 may be at highest risk because they have the highest proportion of distraction-related fatal crashes.

How can distracted driving be prevented?

  • Many states are enacting laws—such as banning texting while driving—or using graduated driver licensing systems for teen drivers to help raise awareness about the dangers of distracted driving and to keep it from occurring.
  • On September 30, 2009, President Obama issued an executive order prohibiting federal employees from texting while driving on government business or with government equipment.
  • On October 27, 2010, the Federal Motor Carrier Safety Administration enacted a ban that prohibits commercial vehicle drivers from texting while driving.

San Jose families mourn Highway 152 crash deaths resulting in DUI arrest

Relatives are preparing to lay two San Jose women to rest after authorities say they were killed in a car crash near Los Banos last week at the hands of a San Jose man driving against traffic while on drugs.

Alicia Carranza, 40, and 30-year-old Sara Castro Chiti were passengers in a Ford F-150 pickup on eastbound Highway 152 approaching Interstate 5 in the early-morning hours of Oct. 9 when the truck was hit head-on by a Ford Explorer going the wrong way, according to the California Highway Patrol and Merced County Sheriff’s Office.

Chiti was pronounced dead at the scene. Carranza was airlifted to a Modesto hospital, where she died. Another passenger in the pickup, 23-year-old San Jose resident Maria Can, was hospitalized with major injuries. The pickup driver, 23-year-old Victor Manual Herrera of San Jose, suffered minor injuries.

The driver of the wrong-way Ford Explorer, 68-year-old San Jose resident Ali Farsad, suffered minor injuries and was soon arrested on suspicion of multiple counts of vehicular manslaughter and driving under the influence of illegal drugs. He is being held in Merced County Jail on $304,404 bail. It was not immediately clear what drugs Farsad was allegedly using.

Friends and relatives said the four people in the F-150 were headed to Los Angeles for janitorial jobs there when the crash occurred.

Chiti emigrated from the small Guatemalan town of Totonicapán seven years ago, and other than brother Govany Castro and sister-in-law, her family still lives there. Castro remembered his sister, who once cleaned houses in SanJose before getting her current job in Southern California, as a social person who doted over his 2-year-old son.

“She was friendly, outgoing and had a lot of friends,” Castro said. “And she totally loved my son.”

Carranza was a friend and co-worker of Chiti; her family could not immediately be reached. Can is Govany Castro’s sister-in-law.

A funeral Mass for the two women is tentatively planned for Thursday morning at Our Lady of Guadalupe Church on San Antonio and Jackson streets in San Jose.

The Law Offices of Gary A. Kessler are licensed to practice in California, District of Columbia & Pennsylvania. Through local law firms with which we have associations, we are able to represent Personal Injury and Wrongful Death cases across the United States. Our associations allow us to represent clients"pro hac vice", meaning "for this particular occasion". In order to effectively and efficiently represent the client in these cases, we will employ the local law firms (at no additional cost to our client) to make routine court appearances and proceedings where it is necessary to assist our clients case.
