The term “wrongful death” is defined as the death of an individual as a result of the negligence, carelessness, intentional act of another individual, corporation, company or entity.  Filing a proper wrongful death claim is extremely difficult and complex for families because they are not only dealing with their grief over the death of a beloved family member, but also complex issues of compensation as well.  Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money as well as loss of support and grief due to the wrongful death of the decedent.

In most states, if the death of a relative or spouse was caused by the wrongful act of another, surviving family members can file a wrongful death lawsuit against the negligent party or parties.  In order to file a wrongful death claim, you must be able to prove that you will experience severe future emotional and financial hardship because of the loss of the death of a relative, family member or spouse.

Fatal Traffic Collision in Hesperia

On April 23, 2013 at about 2:50 p.m, Deputies from the Hesperia Station and units from the California Highway Patrol along with rescue personnel from the San Bernardino County Fire Department responded to a report of a two vehicle, head on traffic collision in the area of Hwy 138 and Little Horsethief Ranch Rd. in Hesperia. It was reported that the two vehicles had collided head on and that there were serious injuries to several parties. Rescue personnel arrived on scene and discovered that the male driver of a 1991 Ford Explorer was trapped inside his vehicle and suffered fatal injuries upon impact. The driver was later identified as Robert E. Miller, age 57 of Victorville. A male passenger from that same vehicle was suffering from injuries, not life threatening.

Three occupants from the second vehicle, a 1999 Toyota minivan were also seriously injured, one with life threatening head injuries. Rescue personnel extricated the victims from their vehicles and all were transported to Arrowhead Regional Medical Center by both air and ground transportation.

The Hesperia Station Major Accident Investigation Team (MAIT) responded to conduct the investigation. It was determined that for unknown reasons the driver of the Ford Explorer who was traveling east on Hwy 138 at an undetermined speed, crossed over into the westbound lanes and collided head on into the Toyota minivan as it traveled west on Hwy 138.

Hwy 138 was closed in both directions between Summit Valley Rd. and Hwy 173 until about 1930 hours while investigators processed the scene for evidence. At this time the exact cause of the collision and why the driver of the Ford Explorer crossed into the westbound lane is still under investigation by the Hesperia Station Traffic Division MAIT Investigators.

Fiery Wreck On Interstate 10 kills Two

A hit-and-run driver fleeing from an accident — and traveling the wrong direction on Interstate 10 — slammed head-on into a pickup, causing a fiery wreck that killed him and the motorist he hit, according to California Highway Patrol officials. The crash happened at 1:22 a.m. Sunday, March 31, about a half-mile east of Brookside Avenue in Beaumont, coroner’s investigators said in a written statement. Francisco Hernandez, 23, of Highland, left the scene of a traffic collision in a 2012 Toyota TC, according to CHP and coroner’s officials. Hernandez was driving west in the interstate’s eastbound lanes and crashed into a 2004 GMC Sierra pickup, CHP officers determined. The GMC was driven by a 45-year-old Beaumont man whose name the coroner’s office has not yet released. The collision caused the pickup to catch fire. It was fully ablaze by the time Cal Fire/Riverside County fire crews arrived. The Beaumont man’s body was badly burned, the CHP said. Fire officials said a third person suffered major injuries. It was not clear which vehicle that person was in.

Lakeland Village: Two motorists killed in head-on crash identified

Riverside County fire crews were on the scene of a head-on crash in which two motorists –both male — were killed this evening in Lakeland Village, it was reported.

According to a Riverside County Fire Department, the collision between a white sedan and charcoal-colored pickup truck occurred at 5:15 p.m. Tuesday, Jan. 29 at Grand Ave. and Adelfa Street.

One passenger — a male who was not identified — was transported by ground ambulance to a local hospital with injuries described as minor to moderate, according to Riverside County Fire Department spokeswoman Jody Hagemann.

Riverside County Coroner’s office has released the names of the two men killed in Tuesday night.

William Messemore, 40, the driver of the pickup truck, and Matthew Camilli, 25, driver of the Dodge Neon, were both killed in the head-on crash that occurred on Grand Ave. and Adelfa St.

Both were residents of Lake Elsinore.

According to California Highway Patrol officer Brian Keene, the driver of the charcoal-colored Toyota Tacoma was speeding southbound on Grand Avenue and may have been drunk when he struck head-on a Dodge Neon that was stopped facing northbound.

Keene said witnesses estimated the pickup’s speed at about 70-80 mph.

Drivers in both vehicles were killed in the crash. Both cars were registered in Lake Elsinore.

A passenger in the truck was transported to a local hospital with minor injuries.

Keene said that one witness who’d come upon the scene of the collision recognized the two men from the truck as having just come from a thrift shop where they were inquiring about purchasing a microwave.

The witness said the pair carried “beer cans in their hands, were staggering (and had) slurred speech,” Keene said.

Of the driver in the Dodge Neon, Keene said: “There was nothing he could have done. He was just stopped, minding his own business, looking to turn left.”
